Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") form a legal agreement between you and Flona ("Flona," "we," "us," or "our") governing your access to and use of the Flona mobile application, website, and related services (together, the "Service"). By creating an account or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, do not access or use the Service. If you are using Flona on behalf of a minor as a parent or legal guardian, you agree to these Terms on that person's behalf and take responsibility for their use of the Service.

2. Description of the Service

Flona is a diabetes management application designed to help users organize and understand information related to insulin doses, carbohydrate intake, glucose trends, and other day-to-day diabetes-related decisions. Flona offers tools including manual and AI-assisted logging, an AI food-image analysis feature, a food search feature backed by the USDA FoodData Central database, reminders, and daily summaries.

The Service is intended to be a support and organizational tool. It is not a substitute for professional medical care, as described fully in Section 3.

3. Medical disclaimer

By using Flona, you understand and agree that:

• Any insulin dose information, carbohydrate estimations, nutritional calculations, AI-generated analyses, reminders, summaries, or other output provided by the Service are intended for informational and educational purposes only, and do not constitute medical advice, diagnosis, or treatment.
• Flona does not calculate, recommend, or approve specific insulin doses on a physician's behalf. Any figures shown by the app are a personal record-keeping aid based on data you provide, not a clinical instruction.
• AI-generated food-image analysis and carbohydrate/protein estimates may be inaccurate, and should be treated as an approximation. Estimates can be affected by photo quality, portion size, and food composition. When accuracy matters, use the food search feature (Section 4.2) or verify with a trusted nutrition source.
• You remain fully responsible for all treatment decisions, including insulin dosing, diet, and any other diabetes management choices, regardless of any information, estimate, insight, or reminder generated by Flona.
• You should always consult your physician, endocrinologist, diabetes educator, or other qualified healthcare provider before making any changes to insulin dosing, medications, diet, or your overall diabetes treatment plan.
• You should never rely solely on Flona during a medical emergency or urgent health situation. See Section 6.
• The developers, owners, employees, and contractors of Flona are not liable for medical decisions made based on information generated by the application, to the fullest extent permitted by applicable law.

This disclaimer applies to every feature of Flona, including but not limited to AI insights, AI food-image analysis, USDA-based food search results, glucose trend summaries, and smart reminders.

4. AI features and food search

4.1 AI food-image analysis

Flona's AI feature allows you to photograph a meal to receive an estimate of its nutritional content, including carbohydrates and protein. This estimate is generated using automated image-recognition technology and is provided "as is," without warranty of accuracy or completeness. AI estimates should be treated as a helpful starting point, not a verified value.

4.2 USDA FoodData Central search

As an alternative to AI estimation, Flona offers a food search feature that retrieves nutritional data from the USDA FoodData Central database, a public reference maintained by the U.S. Department of Agriculture. You must enter a food weight or serving size for Flona to calculate nutritional values based on the USDA reference data. While USDA FoodData Central is a verified public data source, calculated values still depend on the accuracy of the serving size you provide, and on how closely the selected database entry matches your actual food. Flona is not affiliated with or endorsed by the USDA, and USDA FoodData Central data is used under its applicable public-use terms.

4.3 No guarantee of accuracy

Neither AI-based estimates nor USDA-sourced calculations are guaranteed to be accurate, complete, or suitable for any particular medical purpose. You are responsible for using clinical judgment, and where appropriate, consulting your healthcare provider, before acting on any nutritional or dosing information shown in the app.

5. Accounts and eligibility

• You must provide accurate, current information when creating a Flona account and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Flona is intended for use by adults, or by a parent/legal guardian managing the account and data of a minor with diabetes. If you are using Flona on behalf of a child, you represent that you are their parent or legal guardian, or otherwise authorized to manage their health information.
• You must notify us promptly of any unauthorized use of your account.

6. Your responsibilities

When using Flona, you agree that you will:

• Use the Service only for its intended purpose of supporting your personal diabetes self-management.
• Not rely on Flona as a substitute for professional medical advice, diagnosis, or treatment.
• Verify important nutritional or dosing decisions with your healthcare provider or a verified data source (such as USDA food search) when accuracy is critical.
• Not use the Service to provide medical advice or treatment recommendations to third parties.
• Not attempt to reverse-engineer, disrupt, or misuse the Service, including the AI or food-database features.
• Provide accurate information when logging data, understanding that inaccurate input will affect the usefulness of any insight or summary generated.

8. Subscriptions and payment

Flona may offer free and paid subscription tiers. Where applicable, pricing, billing frequency, and cancellation terms will be presented to you at the time of purchase. Subscriptions may renew automatically unless cancelled before the renewal date, in accordance with the terms of the app store or payment processor through which you subscribed. Fees are non-refundable except where required by applicable law.

9. Intellectual property

The Flona application, including its design, branding, text, graphics, software, and underlying technology, is owned by Flona or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You retain ownership of the personal data and content you input into Flona, subject to the license you grant us to process it as described in our Privacy Policy in order to provide the Service.

10. Limitation of liability

To the fullest extent permitted by applicable law, Flona and its owners, developers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of health, life, data, or profits, arising out of or related to your use of, or inability to use, the Service — including reliance on AI-generated estimates, USDA-sourced nutritional calculations, insulin dose logs, reminders, or any other content or feature of the app.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by proven gross negligence, where such limitation is not permitted.

11. Indemnification

You agree to indemnify and hold harmless Flona and its owners, developers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or any medical or treatment decision you make based on information from the Service.

12. Termination

You may stop using Flona and delete your account at any time through the app's account settings. We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law. Upon termination, your right to use the Service will cease, and your data will be handled in accordance with our Privacy Policy.

13. Changes to the Service or these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time to reflect changes in our Service or applicable law. If we make material changes, we will provide notice through the app or by email before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Flona is legally established, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence provide otherwise. Any disputes arising from these Terms or the Service will be resolved in the competent courts of that jurisdiction, subject to any mandatory rights you have to bring proceedings in your local courts.
